General Terms and Conditions of Online Sales

1. General

These General Terms and Conditions (hereinafter referred to as GTC) apply to any purchase of products or services made by a customer via the website of Wyser AG, www.wyser.ch (hereinafter referred to as Website).

The images on the Website are for illustrative purposes only and do not form part of the contractual terms and conditions. The information, in  catalogues and leaflets is for information purposes only and does not constitute contractual documents.

Wyser AG accepts no responsibility for any errors or omissions in connection with drawings, pictures or diagrams or in the catalogues or leaflets or on the websites.

Wyser AG and its partners reserve the right to amend the GTC at any time. The version of the GTC valid at the time of the order shall prevail and cannot be unilaterally changed for this order. The GTC are available in English, German and French. In the event of any discrepancies, the French version shall prevail.

All products and services offered on the website are intended exclusively for customers who have their place of residence/business in Switzerland.

 2. Scope of application

Wyser AG handles your order in accordance with the General Terms and Conditions valid at the time of the order. You have the option of printing out the text of the terms and conditions. Wyser AG only recognizes the provisions available in these terms and conditions.

3. Prices

The prices indicated on the website are exclusively in Swiss francs. They are inclusive of all taxes (VAT). All orders are payable in Swiss francs only. Wyser AG reserves the right to change its prices at any time, but the prices charged to the customer for the products supplied are those in force at the time of the order and stated in the order confirmation.

4 Contract conclusion

The products and prices published in the online shop constitute an offer. However, this is always subject to the resolutory condition that delivery is possible or that the price quoted (by Wyser AG) is error-free.

The contract is concluded as soon as the customer places his order with Wyser AG. The receipt of the order will be confirmed to the customer by an automatically generated e-mail sent to the address provided by the customer. The automatically generated order confirmation e-mail does not constitute a guarantee of availability or delivery. It merely informs the customer that Wyser AG has received his order and that the contract has been concluded subject to the proviso that the price indicated corresponds to the price of the items ordered and that delivery is possible.

5 Order

An order is not binding until it has been accepted by Wyser AG. The sending of the order by the customer means that he accepts these GTC in their entirety, to the exclusion of all other terms or conditions. Wyser AG reserve the right to refuse a customer’s order without giving reasons.

6 Execution of the order

Wyser AG will execute the order in accordance with the main elements specified by the customer via our e-shop. Your order will be confirmed by Wyser AG by e-mail. The confirmation will contain the main elements of the order. The customer is requested to check the order for spelling or invoicing errors and to check whether the price and content correspond to the order. Please inform Wyser AG as soon as possible of any errors by contacting us at info@wyser.ch.

7.Delivery

The articles will be delivered within the limits of the available stock in the warehouse of Wyser AG to the address indicated on the order.

8. Terms of payment

Payment will be made by invoice.

The ordered articles are payable in advance. The goods will be sent as soon as we have received the payment.

Customers also have the option to pick up their order at Wyser AG and pay for it directly. Please contact us at info@wyser.ch.

9. Returns of goods

For returns in the event of a problem, please contact Wyser AG at info@wyser.ch. The customer has 10 days from receipt of the order to make a claim. Wyser AG will only accept unused material in its original packaging. All refunds will be made to the customer’s account. No cash refunds will be made.

10. Applicable law and place of jurisdiction

The present conditions as well as the purchases made in the e-shop are subject to Swiss law. The competent court of jurisdiction in the event of a dispute concerning the order is the court of Geneva, Switzerland.
